Terms of Service

Welcome to Switchboard. These Terms of Service govern your use of the Switchboard mobile application and related services (the "Service") operated by Caravan Electric, LLC ("Switchboard", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use Switchboard. By using the Service you represent that you meet this requirement and have the legal capacity to enter into binding contracts.

2. The Service

Switchboard is a hyperlocal marketplace platform with three boards:

Switchboard is a platform that facilitates transactions between users. We are not party to those transactions and do not own, sell, rent, or perform any goods or services listed on the platform.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You agree to provide accurate, current information and to update it as needed.

5. Payments and Fees

5.1 Payment Processing

Payments on Switchboard are processed by Stripe and Stripe Connect. By using payment features you also agree to Stripe's Terms of Service, and if you receive payments, the Stripe Connected Account Agreement.

5.2 Platform Fees

Switchboard charges a 10% platform fee on each transaction: 5% from the paying party and 5% from the receiving party. The fee is taken at the time of payment as a Stripe application fee. Stripe's own processing fees (~2.9% + $0.30) are paid by the buyer in addition to the transaction amount.

5.3 Payouts to Tool Owners and Contractors

Tool owners and contractors must complete Stripe Connect Express onboarding (bank account, identity verification) before they can list tools or accept jobs. Once verified, payments are routed by Stripe directly to your bank account on a weekly schedule (Fridays by default). Switchboard does not hold, transmit, or take possession of user funds at any time.

5.4 Refunds and Disputes

Refund eligibility is determined on a case-by-case basis and is not guaranteed. Email [email protected] for refund requests. See our Refund Policy for details. Chargebacks initiated through your bank or card issuer may result in account suspension while investigated.

6. Tax Obligations

You are solely responsible for determining and fulfilling your tax obligations arising from activity on Switchboard, including income taxes, self-employment taxes, and any other applicable taxes.

Pursuant to IRS requirements, Stripe will issue an IRS Form 1099-K to users who cross the applicable reporting threshold for the tax year. Tool owners and contractors are independent contractors and marketplace sellers, not employees of Switchboard.

7. ToolBoard-Specific Terms

All tools are rented "as is" with no warranties. Tool owners are responsible for accurately representing the condition of their tools. Renters are responsible for returning tools in the condition received, ordinary wear excepted. Damage disputes are resolved between the renter and owner, with Switchboard's optional mediation.

8. TradeBoard-Specific Terms

Switchboard does not screen, license, verify, or endorse contractors. Clients hire contractors at their own risk. We strongly recommend independently verifying licenses, insurance, and references before hiring any contractor for work that requires them.

9. Limitation of Liability

To the maximum extent permitted by law, Switchboard and Caravan Electric, LLC are not liable for any damages, losses, or injuries arising from: use of the platform, transactions between users, lost or damaged property, personal injury, user conduct, payment issues, platform downtime, or data breaches. The platform is provided "as is" without warranties of any kind.

10. Termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, harm other users, or otherwise act contrary to the spirit of the community. Appeals may be submitted to [email protected].

11. Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the app or by email. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Island County, Washington.
